Why Nevis
The Island of Nevis is an independent, democratic State situated
in the Caribbean, South East of Puerto Rico and West of Antigua.
Nevis is located next to the Island of St Kitts and together they
form the Federation of St Kitts and Nevis. Local time is 4 hours
behind London, with 9am in Hong Kong being 9pm the previous day
in Nevis.
Its geographic location affords Nevis with a strategic advantage
in dealing with both the European and North American markets. The
legal system is based on British common law and closely reflects
that of other common law jurisdictions. Nevis enjoys a highly developed
infrastructure for business and there is a well-educated English
speaking labor force with 98% literacy, one of the highest in the
Western world. The country has sophisticated telecommunication links
with the rest of the world and regular air services directly to
the USA (Puerto Rico) and other Caribbean Islands. There are no
foreign exchange controls on the local currency (the Eastern Caribbean
Dollar) with complete freedom to repatriate capital and profits.
In addition to the local currency, US dollars are widely accepted.
The business and official language is English.
Why GCSL Nevis
GCSL Nevis is licensed as a registered agent by the Nevis Financial Services Department and offers a full range of corporate administration services including assistance with company formation, provision of directors and nominee shareholders, company management and secretarial services, bank account opening and trustee services.
Several features of its legislation make Nevis an offshore jurisdiction
of choice. These include:
| |
 |
Entities established within the
offshore jurisdiction are EXEMPT from any form of taxation in
Nevis including stamp duty, capital gains tax, capital duty
and withholding tax. |
| |
|
|
| |
 |
Strong confidentiality provisions
apply in Nevis. The identities of beneficial owners and shareholders
are not required to be filed on public record. When there is
a change in director, shareholder or officer, such changes do
not have to be reported to the Registrar of Companies. Company
records can be kept anywhere in the world. Confidentiality of
information is protected by legislation that prohibits the disclosure
of any information obtained in the course of business, and applies
to banks and professionals as well as Government officials.
The law imposes a penalty of a fine and/or a term of imprisonment
of up to twelve months. |
| |
|
|
| |
 |
Nevis Business Corporations (NBCs)
permit a great deal of flexibility in corporate structure with
provisions to ensure ease of administration. Incorporation can
generally be completed within 24 hours. |
| |
|
|
| |
 |
Nevis Limited Liability Companies
(LLCs) are considered by many practitioners as the leading entity
of this type in the offshore world. This is reflected in the
significant number of Nevis LLCs registered in the jurisdiction. |
| |
|
|
| |
 |
Nevis is highly regarded for
its "Asset Protection Trust" legislation including
rules against forced heirship, perpetuities, foreign judgments
and fraudulent transfer and disposition. All non-criminal judicial
proceedings relating to international trusts are held in private
and no detail may be published without leave of the court. |
| |
|
|
| |
 |
An international trust is NOT
required to file any returns, reports, or records. The only
document filed with the Registrar is a form with the name of
the trust, trustees and date of the settlement and this is not
publicly available. |
| |
|
|
| |
 |
NBC's, LLCs and international
trusts can be migrated into Nevis and there are emergency provisions
available for transfer of domicile and proper law. |
| |
|
|
| |
 |
Foreign judgments are NOT enforceable
against an international trust, LLC or NBC. Any claimant must
commence completely new proceedings in Nevis, subject to Nevis
law and a USD25,000 bond deposited in order to file suit. |
| |
|
|
| |
 |
Any proceedings to be commenced
in the Courts of the Federation of St Kitts and Nevis to set
aside the settlement of any international trust or disposition
to such trust must be brought within 2 years of the settlement
of disposition. |
